SOLUTIE: 413 NCPC/244 CPC
Suspenda judecata cauzei, potrivit art. 413 alin. 1 pct. 1 ind. 1 Cod Procedura Civila, pana la pronuntarea deciziei preliminare de catre Curtea de Justitie a Uniunii Europene urmare sesizarii din Dosarul nr. 1361/88/2023 al Curtii de Apel Constanta.
Cu recurs pe toata perioada suspendarii, cererea de recurs depunandu-se la Tribunalul Arges.
Pronuntata azi, 30.01.2025, la Tribunalul Arges, Sectia pentru Conflicte de Munca si Asigurari Sociale, prin punerea solutiei la dispozitia partilor de catre grefa instantei.

SOLUTIE: Amana cauza
Incuviinteaza, pentru parti, proba cu inscrisuri.
Incuviinteaza si proba cu relatii solicitata de Sindicat, in sensul celor mentionate in nota de probatorii depusa la acest termen respectiv: sa precizeze paratul daca reclamantii, membri de sindicat, au desfasurat activitate in perioada 23.10.2020-prezent si precizari in legatura cu indemnizatia de concediu de odihna acordata reclamantilor in perioada 23.10.2020-prezent, respectiv daca in modul de calcul a acesteia a fost inclus sau nu si cuantumul, indemnizatiei de hrana, iar in cazul in care a fost inclusa si indemnizatia de hrana, incepand cu ce perioada a fost luata in considerare in formula de calcul a indemnizatiei de concediu acordate, precum si inscrisuri doveditoare in acest sens.
Amana judecarea cauzei la data de 30.01.2025, pentru administrarea probei cu inscrisuri.
Partile au termen in cunostinta.
Cu cale de atac odata cu fondul.
Pronuntata in sedinta publica, azi 13 iunie 2024, la Tribunalul Arges-Sectia pentru conflicte de munca si asigurari sociale.
