SOLUTIE: Admitere apel
Respinge apelul declarat de apelanta ASSET RECOVERY I.P.U.R.L. in calitate de lichidator judiciar al debitoarei societatea OPTIMSERV S.R.L. impotriva sentintei civile nr.678/2024 pronuntata la data de 03.04.2024 de Tribunalul Specializat Cluj in dosar nr.499/1285/2019/a19.
Admite apelul declarat de apelantii PRUNEAN SIMION si PRUNEAN MARIANA STELA impotriva sentintei civile nr.678/2024 pronuntata la data de 03.04.2024 de Tribunalul Specializat Cluj in dosar nr.499/1285/2019/a19, pe care o schimba, in parte, in sensul ca:
Obliga lichidatorul judiciar Asset Recovery I.P.U.R.L. al debitoarei societatea OPTIMSERV S.R.L. sa efectueze o expertiza topografica in vederea determinarii cotelor-parti din imobilele ( constructii si teren), aferente celor 4 apartamente si 4 garaje care se cuvin contestatorilor Prunean Simion si Prunean Mariana Stela, conform contractului autentificat de notarul public Mihutiu Oana, sub nr.222, in data de 27.02.2015.
Pastreaza restul dispozitiilor sentintei apelate.
Constata ca intimatii BOCOS PETRUTA CRISTINA, CUIBUS MIHAELA, CUIBUS ALEXANDRU DORIN, KOVACS ROBERT LAJOS, KOVACS TUNDE, SUSCA PETRU, BORA VIORICA, TODEA LICIVU, TODEA ANICA, CIMPEAN LUCIA, SUSMAN VALERIU SERGIU, MURESAN DOINA LACRAMIOARA, POPA MIHAI, FILIP MARIA, PESTEAN ANCA, CALACEANU IOAN CORNELIU, CALACEANU MONA CORINA, FARCAS LIVIU si FARCAS FELICIA sunt titularii unei creante curente in cuantum de 7.735 lei impotriva averii debitoarei societatea OPTIMSERV S.R.L., reprezentand cheltuieli de judecata in apel.
Definitiva si executorie.
Pronuntata azi, 04.02.2025, prin punerea solutiei la dispozitia partilor prin mijlocirea grefei instantei.
