SOLUTIE: Sesizare ICCJ
Constata admisibila sesizarea Inaltei Curti de Casatie si Justitie in vederea pronuntarii unei hotarari prealabile cu privire la urmatoarea chestiune de drept:
In interpretarea dispozitiilor OUG nr.8/2009 si a Normelor metodologice privind acordarea voucherelor de vacanta, aprobate prin HG nr.215/2009, refuzul angajatorului de a acorda vouchere de vacanta, in conditiile prevederii de sume cu aceasta destinatie in bugetul de venituri si cheltuieli legal aprobat, da dreptul angajatului sa solicite despagubiri, constand in contravaloarea acestor vouchere, precum si in dobanzi legale penalizatoare?
Suspenda judecata apelului, potrivit art.520 alin.2 Cod procedura civila, pana la pronuntarea hotararii prealabile pentru dezlegarea problemei de drept.
Fara cale de atac.
Pronuntata in conditiile art.402 teza finala Cod procedura civila, prin punerea solutiei la dispozitia partilor, de catre grefa instantei, astazi, 22 octombrie 2024, la Curtea de Apel Pitesti – Sectia Civila.
